GENERAL TERMS AND CONDITIONS
1. scope of application
These Terms & Conditions apply to all reservations and guest accommodation contracts concluded between REVIER Hospitality Group AG (Revier Hotels) and third parties (guests) as well as to all other services and deliveries provided by Revier Hotels. The guest is advised that reservation numbers that the guest receives from third parties (e.g. internet portals) are not identical to the reservation or booking number of Revier Hotels. Revier Hotels is entitled to refuse to conclude an accommodation contract with a guest at its own discretion.
2. reservations / resale
Reservations can only be made electronically via the online channels of Revier Hotels or via third parties/agents (e.g. online booking portals). Reservations made by telephone, email or other, non-automated reservation methods require the prior consent of Revier Hotels and may incur higher costs.
The reservation of a hotel room constitutes an accommodation contract. This is binding for both contracting parties. The Terms & Conditions are an integral part of the contract. There is no entitlement to a specific room. Revier Hotels reserves the right to rent the reserved room to another party if the reservation is cancelled. The guest receives a binding booking or reservation number from Revier Hotels, not necessarily a separate written reservation confirmation. The resale/rental and/or subletting of booked rooms is prohibited. The assignment or sale of the claim against Revier Hotels is also not permitted. In such cases, Revier Hotels is entitled to cancel the booking. Use of the hotel room for any purpose other than accommodation is expressly prohibited.
Reservations of more than 9 rooms are subject to the Revier Hotels group policy. For such bookings, a separate accommodation contract to be confirmed by Revier Hotels must be concluded, which includes special conditions governing cancellation and payment terms. Revier Hotels reserves the right not to accept group reservations for which such an accommodation contract has not been concluded, or to cancel them without replacement.
3. Prepaid reservations, cancellation and rebooking
A valid credit card must be provided by the guest at the time of booking or an alternative payment method offered on Revier Hotels' electronic sales channels. Revier Hotels has the right to check the validity of this information immediately and to carry out a pre-authorisation on the credit card or alternative payment method provided. The payment and cancellation conditions communicated at the time of sale apply, which vary depending on the rate.
The reservation of a non-cancellable rate, which is marked as such in the description or conditions, cannot be cancelled or rebooked free of charge. In the event of cancellation or no-show by the guest, the total amount of the stay will be retained.
On the day of Arrival at the latest, the credit card will be charged for the full amount of the overnight stay plus any additional services booked. If it is not possible to charge the credit card, Revier Hotels reserves the right to cancel the reservation. This cancels the guest's right to use the room. If the guest does not show up (no show), the full amount of the stay will be retained in any case and the guest's further right to use the room expires.
Revier Hotels reserves the right to cancel a reservation at any time. Any resulting claims for compensation are limited to the total price of the booked stay.
4. events
For events at which food and drinks are served, the actual number of participants may not be more than 20% below the number stated in the event contract, regardless of the time of the reduction. Otherwise the difference to the maximum reduction will be charged. The organiser is obliged to inform Revier Hotels of the final number of participants no later than 5 working days before the start of the event. If the number of participants increases, the actual number of participants will be used as the basis for invoicing. Reductions in the actual number of participants compared to the final number reported will not be taken into account in the invoice.
5. Registration form and disclosure of personal data
The guest is obliged to provide his personal data and additional information relevant to the registration form in advance via the electronic online registration data portals of Revier Hotels in accordance with the statutory provisions.
6. taxes, fees and charges
The applicable prices are gross total prices and include all statutory taxes, fees and charges with the exception of visitor's tax, which is shown separately. Revier Hotels reserves the right to adjust the prices accordingly in the event of changes to tax, fee and levy rates as well as the levying of new taxes, fees and levies previously unknown to the parties. Accommodation prices are shown per room per night.
7. means of payment
Valid means of payment for hotel accommodation are Mastercard and Visa as well as the alternative payment methods specified on the Revier Hotels website. On the day of departure, the guest will automatically receive the final invoice for the accommodation by email.
8. Possibilities of using reserved rooms
Reserved rooms are available to the guest from 4 p.m. on the day of arrival and until 11 a.m. on the day of departure, unless otherwise agreed at the time of reservation. On the day of departure, the guest must return their hotel room to Revier Hotels by 11.00 a.m. at the latest, vacated and undamaged. If the guest does not vacate his hotel room by 11.00 a.m. on the day of departure in breach of the contract, he will owe Revier Hotels a lump-sum compensation for this reason amounting to 100% of the accommodation price for one night for the hotel room. In addition, Revier Hotels reserves the right to have the room vacated by its staff and to store all of the guest's belongings in the hotel if the guest is late or fails to vacate the room. Revier Hotels assumes no further liability for the items stored in this way beyond the liability conditions formulated in these terms and conditions.
9. Options for using public areas
With the reservation of a room, the guest can use the designated public areas, such as the bar, ski and bike rooms, terrace, etc. free of charge. Revier Hotels reserves the right to close the public areas at short notice without prior notice. In the event that a public area is unavailable, the guest is not entitled to a partial or full refund of their payment for the overnight stay. The public areas are not considered part of the accommodation contract concluded for the booked hotel room.
10. liability of Revier Hotels
Revier Hotels is liable for damages arising from injury to life, limb or health for which it is responsible. Furthermore, Revier Hotels is liable for other damages that are based on an intentional or grossly negligent breach of duty by Revier Hotels as well as for damages that are based on an intentional or negligent breach of typical contractual obligations. Further claims for damages are excluded, unless otherwise regulated in these Terms & Conditions. The liability of Revier Hotels for slight negligence is excluded. Should disruptions or defects occur in the services of Revier Hotels, the guest is obliged to inform Revier Hotels immediately. If the guest fails to notify Revier Hotels by the deadline on the day of departure at the latest, all claims are forfeited. Revier Hotels disclaims all liability for theft and damage to materials and equipment caused by the contracting party or persons authorised and invited by the contracting party. Money, securities, valuables and the like can be stored in the hotel safe.
11. liability of the guest
The guest must treat the hotel room with care and respect. Children under the age of 14 must be supervised by an adult guest at all times during their stay at the hotel. The guest is liable for any damage and consequential damage caused by him/her. This includes, even in the case of slight negligence, all soiling beyond the usual extent, all damage and the costs of a fire alarm, etc. The guest is obliged to comply with the safety regulations.
12. food and drinks brought along
In the public areas, the consumption of brought-in food and drinks is prohibited. Breakfast can only be consumed in the designated areas of the public area. The preparation of food in the rooms is prohibited.
13. Smoking in the hotel
All Revier Hotels are non-smoking hotels. It is therefore forbidden to smoke in the public areas as well as in the guest rooms. In the event of non-compliance, Revier Hotels has the right to claim damages from the guest, including loss of earnings. Smoking is permitted in the predefined outdoor areas.

15. house rules
Revier reserves the right to expel guests from the premises. This applies in particular if you do not follow the instructions of staff, make discriminatory comments, harass or endanger other guests

16. final provisions
In the event of contradictions between the Accommodation Agreement and these Terms & Conditions, the provisions of the Accommodation Agreement shall take precedence. The Accommodation Agreement and these Terms & Conditions contain all agreements between the parties regarding the subject matter of the contract. There are no verbal collateral agreements to the Accommodation Agreement. Amendments or additions must be made in writing. Revier Hotels is authorised to transfer all rights or claims arising from the accommodation contract to third parties

The invalidity of one or more of the above provisions shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic and legal intentions of the parties.
Swiss law shall apply exclusively, to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vaz/Obervaz (CH).
